GAB Sterling recently secured a significant victory for our client in a vigorously contested workers’ compensation claim involving allegations of Complex Regional Pain Syndrome (CRPS).
The claim originated from a straightforward finger injury but later expanded to include allegations of carpal tunnel syndrome and ultimately CRPS, a diagnosis that, if accepted, would have substantially increased both medical and indemnity exposure.
Following extensive litigation including multiple hearings, medical depositions, cross-examinations, and the submission of a detailed legal memorandum by our team, the Court determined that the claimant failed to meet the burden of proof. The Judge found no credible medical evidence supporting a clinical diagnosis of CRPS under the Budapest Criteria, resulting in a full disallowance of that portion of the claim.
